Agreement between User and www.brettrips.com

Please read these Terms & Conditions carefully before submitting any cards to our consignment program. These terms govern the relationship between you (“User”, or “Consignor”) and BrettRips Consignment LLC (“Company,” “we,” “us,” or “our”). www.brettrips.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the “Terms”). Your use of www.brettrips.com constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference.

www.brettrips.com is an E-Commerce Site.

BrettRips Consignment is a sports card consignment company. This website is provided to allow you to communicate with our team and track the progress of your submissions that are being processed by our team. Please review the below terms which are accepted upon creation of an account, and/or accessing and utilizing our website for cards submitted to us.

Eligible Cards & Submission Requirements

We accept all UFC trading cards that meet a minimum estimated market value of $10 or more per card, as determined by recent eBay sold listings at the time of evaluation. We do not accept unauthenticated autographed cards. Any visible damage on submitted cards will be disclosed on-stream during the auction. Cards that do not meet our requirements will be returned to the return address provided on the package sent with the submission. A flat fee of $15 will be applied to any submission that requires a full or partial return due to non-compliant cards. We are not liable for any damage or loss that may occur during the return shipment.

Submission Types & Limits

Standard Submission: A maximum of 50 cards per submission with a processing fee of $1 per card.

Express Submission: A maximum of 15 cards per submission with a processing fee of $5 per card. Express submissions are prioritized and processed within the next scheduled show, provided the package is delivered by Wednesday of that week. Packages received after Wednesday will be included in the following week’s show.

Packaging & Shipping Responsibilities

Users are responsible for packaging all cards securely to prevent damage during transit. Cards should be shipped in standard toploaders or card savers. You must include the provided packing slip inside your package and add the tracking number to your submission. Submissions received without a packing slip/tracking may be returned to the sender unopened. Users are solely responsible for their shipment until it is received and opened at our facility. A delivery scan alone does not transfer liability to BrettRips Consignment LLC. We strongly recommend purchasing shipping insurance for all submissions.

Processing & Sale of Cards

Once your cards are shipped and tracking is uploaded, no further action is required from you. We handle the entire consignment process from receipt through sale. Timing may vary depending on submission volume and show scheduling, turnaround times are not guaranteed for Standard submissions. In the event that we do not process your Express submission in time, we will give you the option of receiving your cards back at our expense or converting your submission to Standard service level. All items are sold via $1 start auctions, and we reserve the right to group, combine, or list items using the auction formats and settings we believe will optimize performance. Auction formats include but are not limited to auction length and sudden death versus non sudden death.

Auction Conduct & Prohibited Activities

This is a zero-tolerance rule. Consignors are not permitted to bid on their own cards under any circumstances. Consignor’s cards are clearly labelled in the auction title with their unique 6 digit submission ID. If a Consignor is found to be bidding on their own cards, from their account on file or from an alternate, all cards in Company’s possession and any funds from the sale of their consigned cards will be forfeited to Company.

Pricing, Fees & Commissions

Processing Fee: $1 per card for Standard submissions; $5 per card for Express submissions.

Whatnot Platform Fee: An 11% fee is charged to the Consignor regardless of any active Whatnot seller promotions. Commission: Our commission is calculated on a per-submission total basis, not per individual card. All rates are shown on the rates page of our website and are locked in upon submission.

Final sale prices are determined solely by market demand within the live stream auction. We are not responsible for cards selling below the Consignor’s expectations. All consignments are made at the Consignor’s own risk.

Payouts

Payouts are processed on a weekly basis. Once your cards are sold, you will receive a financial breakdown of total sales and all fees deducted. Funds are automatically deposited or transferred via your preferred payout method, as selected at the time of submission or changed up until the time of payout.

Discount Codes & Promotions

Discount codes apply exclusively to our commission fee. They do not apply to processing fees, platform fees, or any other charges. For example, if the commission on a submission totals $100 and a 15% discount code is applied, the commission is reduced to $85 while all other fees remain unchanged.

Returns, Cancellations & Non-Compliant Submissions

All sales are final. Once your cards are shipped to us and received, they cannot be returned or withdrawn from the consignment program. Please only submit cards you are fully committed to consigning. Cards that fail to meet our requirements will be returned to the address on file, and a $15 flat return fee will be applied to the submission. We are not liable for damage or loss incurred during return shipments.

Damaged Packages

If your package arrives at the PO BOX (ship to address) or our facility with visible exterior damage (e.g., torn, crushed, or water-damaged packaging), we may not open it. The package may be returned to you unopened to protect both parties in the event that items inside were lost or damaged during shipping.

Limitation of Liability

We are not responsible for any loss, damage, or delays that occur during shipping before your package is received and opened at our facility. We are not liable for final sale prices, which are determined entirely by live auction market demand. We are not liable for any damage or loss incurred during the return shipment of non-compliant cards.

By consigning with us, you acknowledge and accept that all consignments are made at your own risk. We strongly recommend insuring all shipments.

Change of Terms

BrettRips Consignment reserves the right, in its sole discretion, to change the Terms under which www.brettrips.com is offered. The most current version of the Terms will supersede all previous versions. BrettRips Consignment encourages you to periodically review the Terms to stay informed of our updates.

Electronic Communications

Visiting www.brettrips.com or sending emails to BrettRips Consignment constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.

Indemnification

You agree to indemnify, defend and hold harmless BrettRips Consignment, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney’s fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. BrettRips Consignment reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with BrettRips Consignment in asserting any available defenses.

Termination/Access Restriction

BrettRips Consignment reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the state of Florida and you hereby consent to the exclusive jurisdiction and venue of courts in Florida in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and BrettRips Consignment as a result of this agreement or use of the Site. BrettRips Consignment’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of BrettRips Consignment’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by BrettRips Consignment with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the User and BrettRips Consignment with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and BrettRips Consignment with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.
